2. Buyer Responsibilities

By purchasing from IMR Batteries, you agree to the following:

  • You have read and understood the product-specific warnings and will use the products as specified by the manufacturer.
  • Lithium-ion batteries must only be used in system integrations or battery packs with proper protection circuitry (e.g., BMS or PCB).
  • Batteries must not be stored loose in pockets, purses, or near metal objects that may cause short circuits. They must be stored in protective cases or original packaging.

If purchasing for resale purposes:

  • You must forward all safety warnings to your customers.
  • You may not market, sell, or use these products for e-cigarettes, vaporizers, or similar devices.

3. Order Acceptance, Cancellations, and Modifications

All sales are final. Once an order is submitted and a tracking number is issued, it cannot be modified, canceled, or refunded.

We reserve the right to limit or cancel orders at our discretion. If we cancel an order, we will attempt to notify you via email and/or billing contact information provided at checkout.

4. Chargebacks & Payment Disputes

By purchasing from IMR Batteries, you agree to contact us first to resolve any issues before initiating a chargeback or payment dispute.

  • All chargebacks and payment reversals are considered a violation of these Terms.
  • If a chargeback is filed, we reserve the right to:
    • Dispute the chargeback with evidence, including proof of delivery and communication records.
    • Pursue the outstanding balance through collections, which may result in additional fees.
    • Report unpaid debts to credit reporting agencies, where permitted by law.
    • Permanently block your account from future purchases, regardless of the chargeback outcome.

Filing a chargeback against IMR Batteries means you forfeit your ability to place future orders, regardless of the reason or decision by the payment provider.

5. Returns, Refunds, and Exchanges

Due to the nature of our products, we do not accept returns, exchanges, or provide refunds once an order has been shipped.

  • If you receive a defective product, you may request a replacement in accordance with our Return Policy.
  • We do not guarantee compatibility of any cell with any device, application, or use.
  • For orders returned as refused, undeliverable, or due to an incorrect address, refunds will be issued minus:
    • The original shipping cost
    • Return shipping fees charged by the carrier
    • A 20% restocking fee (applied to the product subtotal)

If a returned package is lost or damaged in transit back to us, it will not be eligible for a refund.

6. Disclaimer of Warranties

  • IMR Batteries makes no guarantees of merchantability, suitability, or fitness for a particular purpose.
  • We do not offer warranties, whether express or implied, on any products sold.
  • Any applicable warranties are provided solely by the original manufacturer.

By purchasing from IMR Batteries, you agree to indemnify and hold harmless IMR Batteries, its officers, employees, and agents from any claims, damages, or liabilities arising from:

IMR Batteries is not liable for any indirect, special, consequential, or punitive damages, including lost profits, resulting from product use or agreement to these terms.

Our maximum liability is limited to the total price paid for the product.

Lithium-ion batteries sold by IMR Batteries may not be used for e-cigarettes, vaporizers, or similar devices due to serious safety risks, including fire or explosion.

Improper use of batteries, including without a BMS or PCB, is strictly prohibited.

10. Copyright and Trademarks

  • All website content, text, images, and graphics are the property of IMR Batteries and are protected by copyright laws.
  • Content may only be used for placing orders or purchasing products. Reproduction or distribution without written consent is prohibited.

11. Errors and Accuracy

IMR Batteries reserves the right to correct errors in pricing, descriptions, or availability at any time. Orders placed with incorrect pricing may be canceled, and any charges will be refunded.

12. Dispute Resolution

Mandatory Arbitration

Any disputes, claims, or controversies related to these terms, your purchase, or IMR Batteries’ products must be resolved through binding arbitration in Harris County, Texas, following the rules of a reputable arbitration organization chosen by IMR Batteries.

Waiver of Jury Trial

By agreeing to these terms, you waive your right to a jury trial for any disputes related to our services or products.

Class Action Waiver

All legal proceedings must be conducted on an individual basis. You waive your right to participate in any class action, consolidated action, or representative proceeding.

13. Miscellaneous
